City Lawyer Seeks Out-of-Court Settlement with Tailor Over Destroyed Designer Suit

A city lawyer, Gatheru Gathemia, has requested more time to try and settle out of court with his tailor, Mr Daniel Onyango Dinda, after the designer suit he purchased for Sh35,000 was ruined in May 2021. The lawyer initially took the tailor to court in 2021, demanding compensation for the destroyed Herr Widman grey suit that was burned during alterations, leading to a legal battle that was dismissed in April 2022 due to the court's belief that the agreement to replace the suit was obtained under duress.

In explaining the situation to High Court judge Janet Mulwa, Mr. Gathemia, through his advocate, requested two weeks to negotiate a resolution with the tailor regarding the destroyed suit. According to evidence presented in court, Mr. Gathemia had taken the suit to Mr. Dinda for adjustments in May 2021, but during the ironing process, the coat was accidentally burned. Despite an agreement made for Mr. Dinda to replace the suit in monthly installments of Sh3,000, the lawyer only received the trousers back and not the destroyed jacket, leading to the legal dispute.

In response to the court's dismissal of the case, Mr. Gathemia appealed the decision, citing negligence on the part of the tailor and disputing the magistrate's finding that the agreement was made under coercion. However, Mr. Dinda defended himself by claiming that he was coerced into signing the contract due to alleged threats from the lawyer, expressing his frustration at being pursued in court by someone he considered to be looking down on him as just a tailor.
